Heard both sides.

Petitioner seeks bail in a case under Section 399/402 IPC and section 25 (1-b) A, 26/35 of the Arms Act.

The petitioner was apprehended along with other accused persons and from the possession of the petitioner, one loaded country made pistol, cartridges and mobile set were recovered.

It is submitted that similarly situated co-accused, namely, Madan Kumar and Mukesh Kumar, have already been enlarged on bailvide order passed in Cr.Misc.No.24503 of 2014 and Cr.Misc.No.37046 of 2014 Considering the fact that the petitioner has already remained in jail for about nine years, the petitioner, named above, is directed to be enlarged on bail on furnishing bail bond of Rs.10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of Sri D.K. Mishra, Judicial Magistrate, Ist Class, Patna City in connection with Fatuha P.S.Case No. 123 of 2014 (G.R.No.1109 of 2014.
