JUSTICE VINOD KUMAR SINHA ORAL ORDER 20-02-2020 Petitioner seeks regular bail in connection with Special Case No. 8858 of 2019 arising out of Ram Krishna Nagar P.S. Case No. 715 of 2019 registered for the offence punishable under Sections 37(b)(c) of the Bihar Prohibition & Excise Act, 2016 and Sections 447, 448, 506, 354 and 34 of the I.P.C.

Allegation against this petitioner and one co-accused that they went to the house of the informant in drunken condition and misbehave with the sister of the informant. Submission of the learned counsel for the petitioner is that allegation is false and other co-accused has already been granted bail by the Special Judge, Excise itself. Petitioner is in custody since 06.10.2019. Charge-sheet has already been submitted there is no chance of tempering with the evidence.

Having heard both sides, in view of the facts and circumstances, as stated above, let the petitioner above named, be released on bail on furnishing bail bond of Rs.25,000/- (Rupees Twenty Five Thousand) with two sureties of the like amount to the satisfaction of learned Spcial Judge Excise, Patna, in connection with Special Case No. 8858 of 2019 arising out of Ram Krishna Nagar P.S. Case No. 715 of 2019, subject to the condition that one of the bailors of the petitioner shall be a local person having sufficient immovable property within the jurisdiction of the court concerned.
