JUSTICE HEMANT KUMAR SRIVASTAVA ORAL ORDER 19-01-2015 Heard learned counsel for the petitioner as well as learned Additional Public Prosecutor for the State. Petitioner is in jail custody since 10.11.2014 in a case registered under section 376,328 and 307/34 of the Indian Penal Code.

The allegation against the petitioner is that he established physical relationship with informant on false promise of marriage but when the informant pressurized him for marriage the petitioner and his family members forcibly administered poison to her.

The accusation of administration of poison is not specific against the petitioner and so far as allegation of rape is concerned, according to the informant itself, the physical

Considering the aforesaid facts and circumstances as well as period of detention of petitioner in jail custody, let the petitioner, above named, be released on bail on furnishing bail bonds of Rs. 10,000/- with two sureties of the like amount each to the satisfaction of Sub Divisional Judicial Magistrate (West) Muzaffarpur,in connection withKanti P.S.Case No. 344 of 2013, corresponding to G.R.No. 2154 of 2013.
