The petitioner, namely, Prafful Singh, is in custody in Mohaddinagar P.S. Case No. 115 of 2015 under Sections 384/386 of the Indian Penal Code..

The allegation against this petitioner is that on 20.06.2015, he demanded Rs. 10,000,00.00 from the informant, but the informant did not pay the same nor he informed the police and thereafter, on 30.06.2015 again the petitioner with other persons went at the place of the informant and demanded Rs. 10,000,00.00.

Admittedly, nothing has been paid to the petitioner, according to the F.I.R. itself and only demand was made for that except this statement of the informant, there is nothing on record.

Patna High Court Cr.Misc. No.55726 of 2015 (2) dt.16-12-2015 Considering the nature of allegation and the fact that the petitioner is in custody since 02.07.2015, I direct the petitioner, named above, to be released on bail on furnishing bail bond of Rs.10,000/- (Ten Thousand Rupees) with two sureties of the like amount each to the satisfaction of the learned A..C.J.M., Samastipur, in connection with Mohaddinagar P.S. Case No. 115 of 2015.
