JUSTICE RAKESH KUMAR ORAL ORDER 16-02-2016 Heard Sri Dhananjay Kumar Pandey, learned counsel for the petitioner and Sri Tarun Prasad Mandal, learned A.P.P. The petitioner apprehending his arrest in connection with Deep Nagar P.S. Case No. 348 of 2015 registered for the offence under Section 419, 420, 467, 468 of the Indian Penal Code has prayed for grant of anticipatory bail. It was submitted by learned counsel for the petitioner that the petitioner has been made victim in the present case since the petitioner was having animosity with the candidate who had appeared in the examination for selection of constable and subsequently he alleged that in his place petitioner had participated in the physical test. On the aforesaid ground a prayer has been made to enlarge the petitioner on anticipatory bail. He

Patna High Court Cr.Misc. No.1149 of 2016 (3) dt.16-02-2016 2/2 submits that after completion of the examination the F.I.R. was lodged. There is no allegation that petitioner was detected at the time of participating in the test.

In the facts and circumstances in the event of arrest or surrender within a period of six weeks from today let the petitioner Pawan Kumar be enlarged on bail on furnishing bail bond of Rs. 10,000/- (rupees ten thousand) with two sureties of the like amount each to the satisfaction of Sri R.K. Dwivedi, learned Judicial Magistrate, 1st Class Nalanda / court concerned in connection with Deepnagar P.S. Case No. 348 of 2015 subject to the conditions as contemplated under Section 438(2) of the Code of Criminal Procedure.
