The petitioner is languishing in custody since 17.08.2014 in a case registered for the offences punishable under Sections 461 and 379/411 of the Indian Penal Code. The accusation is of committing theft in the mobile shop of the informant. One motorcyclist was chased, who managed to flee away but from a bag 90 theft mobile were recovered.

It is submitted by learned counsel for the petitioner that nothing has been recovered from the petitioner nor the petitioner has been put on TIP. Statement to that effect has been made in para 10 of the petition.

Patna High Court Cr.Misc. No.1448 of 2015 (02) dt.15-01-2015 2/2 Considering the fact that the petitioner has not been put on TIP, let the above named petitioner, be released on bail on furnishing bail bonds of Rs.10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of learned Sub-divisional Judicial Magistrate, Birpur at Supaul in connection with Birpur P.S. Case No. 163 of 2014.
