JUSTICE ASHWANI KUMAR SINGH ORAL ORDER 15-12-2015 Heard learned counsel for the petitioners and learned counsel for the State.
The petitioners seek bail in connection with Ashok Paper Mill P.S. Case No. 14 of 2015 registered for the offences punishable under Sections 147, 148, 341, 323 and 302 of the Indian Penal Code.
It has been contended that the co-accused Vikku Mandal, whose case is identically situated to that of the petitioners, has already been granted bail by a coordinate Bench of this Court vide order dated 13.08.2015 passed in Cr.Misc. No. 30690 of 2015.
Learned counsel for the State has opposed the application filed on behalf of the petitioners. However, he
Patna High Court Cr.Misc. No.56125 of 2015 (2) dt.15-12-2015 2/2 concedes that the petitioners' case is identical to that of the coaccused Vikku Mandal. Regard being had to the reasons assigned for grant of bail to the co-accused Vikku Mandal in the aforesaid order dated 13.08.2015, as contained in Annexure-4 to the present application, the petitioners, namely, Sikander Das and Chhathu Das are directed to be released on bail on furnishing bail bond of Rs.10,000/- (Rupees ten thousand) each with two sureties of the like amount each to the satisfaction of the learned A.C.J.M., Darbhanga in connection with Ashok Paper Mill P.S. Case No. 14 of 2015.
