====================================================== CORAM: HONOURABLE MR. JUSTICE RAJENDRA KUMAR MISHRA ORAL ORDER 02-06-2020 Heard learned counsel for the petitioner, learned A.P.P. for the State and the learned counsel for the informant through Video Conferencing.

The petitioner seeks bail in connection with Kargahar P.S. Case No.238 of 2019 registered under Sections 302 and 386/34 of the Indian Penal Code besides Section 27 of the Arms Act. The accusation is that on 18.09.2019 at about 02.00 P.M., the informant along with his family members was at his door. At that time, his villagers, Tej Pratap Singh alias B.K. Singh, C.K. Singh and D.K. Singh (petitioner), all sons of Rajendra Singh, along with two unknown came there boarding on Xylo vehicle and made demand of ransom of Rs.1,00,000/- giving threatening that if the ransom amount is not paid, then they would kill them. No.8750 of 2020(3) dt.02-06-2020 2/2 the brother of the informant, made protest, then Tej Pratap Singh exhorted his two brothers to shot fire at him and himself fired 3/4 rounds at him. C.K. Singh also fired twice at the leg of the brother of the informant, due to which he became unconscious and fell down. Thereafter, all moved from there.

Submission is that, admittedly, the petitioner and other coaccused are the co-villagers of the informant and due to enmity and dirty village politics, the petitioner has falsely been implicated in this case without any overt act. The petitioner has no criminal antecedent and is in custody since 15.10.2019.

Having regard to the facts and the circumstances of the case, the petitioner, above named, is directed to be released on bail on furnishing bail bond of Rs.10,000/-(Rupees Ten Thousand) with two sureties of the like amount each to the satisfaction of the Chief Judicial Magistrate, Rohtas at Sasaram, in connection with Kargahar P.S. Case No.238 of 2019.
