JUSTICE CHAKRADHARI SHARAN SINGH ORAL ORDER 14-03-2016 Heard learned counsel for the petitioner and learned counsel appearing on behalf of the State.
This application for grant of anticipatory bail arises out of Hajipur Town P.S. Case No. 25 of 2012, disclosing offences under Sections 409,420,120B/34 of the Indian Penal Code. Considering the circumstances that the petitioner was named in the First Information Report on the very date of the institution of the First Information Report in January, 2012 and he started taking steps for grant of anticipatory bail at least three years thereafter, I am not inclined to entertain this application at such belated stage.
This application is, accordingly, rejected.
The petitioner is directed to surrender before the Court below within four weeks from today and seek regular bail, if so advised. If he does so, his application for regular bail shall be
Patna High Court Cr.Misc. No.2425 of 2016 (5) dt.14-03-2016 considered on its own merit without being prejudiced by rejection of present application for grant of anticipatory bail for the reason that I have not gone into the merits of the allegation made in the First Information Report against the petitioner and the materials which have been collected by the Police during the course of investigation.
