JUSTICE DINESH KUMAR SINGH ORAL ORDER 13-01-2015 Heard learned counsels for the petitioner and the State. The petitioner is languishing in custody since 19.5.2014 in a case registered for the offences punishable under Sections 328 and 302/34 of the Indian Penal Code.

It is alleged that the parents of the informant and the informant himself went to Patna in search of his brother Ranjit Sah who went missing since one and half months. The informant came back to his house but the parents of the informant and sister in law stayed there. Next day the informant was informed that Uma Devi (wife of the petitioner), Birendra Sah, Ranjan Kumar and Harikishor Sah killed the father of the informant by administering poison.

It is submitted by the learned counsel for the petitioner that only on suspicion the accusation has been levelled whereas

Patna High Court Cr.Misc. No.1224 of 2015 (2) dt.13-01-2015 2/2 the wife of the petitioner has been granted bail vide Cr. Misc. No. 1118 of 2014.

Considering the aforesaid facts, let the above named petitioner be released on bail on furnishing bail bond of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of learned 5th Additional Sessions Judge, Motihari, East Champaran in connection with S.T. No. 613 of 2014 arising out of Kalyanpur P.S. Case No. 142 of 2013.
