Although petitioner is named in the first information report but the informant has given name of the petitioner on the basis of suspicion.

In course of investigation two mobile sets were recovered from possession of the petitioner but petitioner claimed himself to be owner of the aforesaid seized mobile sets. Moreover, aforesaid mobile sets have not been put on test identification parade. Accordingly, petitioner is directed to be released on bail on furnishing bail bonds of Rs 10,000/- with two sureties of the like amount each to the satisfaction of the Chief Judicial Magistrate, Araria in Araria (Bairgachhi) P.S.
