2. The present writ petition has been filed by the petitioner for issuance of writ directing the respondent No.3, the District Collector, Vaishali at Hajipur, to decide his Baskit Parcha Appeal Case No.R-153/2012-13 which is pending before him since 2012-13.

3. Learned Counsel for the petitioner submits that the said appeal has been filed by the petitioner under the Bihar Privileged Persons Homestead Tenancy Act, 1947.

4. Learned Counsel for the State submits that filing reply is necessary in this case.

But it transpires to this Court that under the Bihar Privileged Persons Homestead Tenancy Act it is the Collector who has to pass the order and according to the pleading of the petitioner the matter is pending since 2012-13. Therefore, keeping this case pending before this Court shall not serve any purpose and, hence, in that view of the matter, this Court hereby dispose off the writ petition directing the Collector, Vaishali at Hajipur to pass final order in Baskit Parcha Appeal Case No.R153/1012-13, if it has not been finally disposed off, within 90 days from the date of receipt/production of a copy of this order.
