The petitioner apprehends his arrest in a case registered for the offences punishable under Sections 304 B & 201/34 of the Indian Penal Code.
Petitioner along with other accused persons is said to have killed the daughter of the informant on non-fulfillment of dowry demand.
It is submitted by learned counsel for the petitioner that no such occurrence as alleged ever took place. He has been falsely implicated in this case due to dirty village politics. The allegation levelled against the petitioner is not specific rather general and omnibus in nature. Petitioner is
Patna High Court CR. MISC. No.9298 of 2020(3) dt.15-06-2020 2/2 neither the family members nor relative rather he is a covillager of the husband of the deceased. There is no specific allegation of demand of dowry or any overt act against the petitioner. He has no criminal antecedent. Similarly situated coaccused, namely, Ganaur Thakur @ Ganaur Sharma has been enlarged on regular bail by a co-ordinate bench of this court vide order dated 17.10.2019 passed in Cr. Misc. No.64401 of 2019.
Having regard to the facts and circumstances of the case, let the above named petitioner, be released on bail, in the event of his arrest or surrender before the learned Court below within a period of six weeks from today, on furnishing bail bond of Rs. 25,000/- (Rupees Twenty Five Thousand) with two sureties of the like amount each to the satisfaction of the learned A.C.J.M.-III West, Muzaffarpur in connection with Kudhani (Turky O.P.) P.S. Case No. 372 of 2019, subject to the condition as laid down under Section 438 (2) of the Cr.P.C. (Anjani Kumar Sharan, J) Trivedi/- U T
