1. Heard the parties.
2. The petitioner apprehends his arrest in connection with Muffasil P.S. Case No. 730 of 2023 dated 5/7/2023 registered under Sections 406, 420, 467, 468, 471 / 34 of the I.P.C.
3. As per the prosecution case the petitioner along with the co-accused arrived at the house of the informant on 30/11/2021 and persuaded him to invest a sum of 1 Crore 80 Lakh in the work allotted to the accused persons for excavation of sand with promise that after three months 2 Crores 30 Lakh would be returned against the principal amount of 1 Crore 80 Lakh. It has further been alleged that the accused persons returned some of amount but the rest amount has not been returned.

4. Learned counsel for the petitioner submits all the money was transferred in the account of the co-accused / Ravi Shankar Kumar which would be evident from the statement made in the F.I.R. itself. The co-accused / Ravi Shankar Kumar has returned all the money to the informant and has been granted regular bail by learned district court which would be evident from the impugned order itself. A compromise petition has also been filed by the informant in the concerned court stating therein that money has been returned to him.

Regard being had to the submission made by the parties, taking into consideration the fact that according to the petitioner entire amount has been returned to the informant and the co-accused / Ravi Shankar Kumar has been granted regular bail by the concerned district court, I am inclined to grant anticipatory bail to the petitioner.
6. Let the petitioner, above named, be released on anticipatory bail in the event of arrest or surrender before the court below within a period of four weeks from today on furnishing bail bond of Rs. 10,000/- (rupees ten thousand) with two sureties of the like amount each to the satisfaction of Chief Judicial Magistrate, Gaya in connection with Muffasil P.S. Case No. 730 of 2023 subject to the condition as laid down under
