2. The petitioner apprehends his arrest in Hajipur Sadar P.S. Case No. 567/2024, registered for offence under Sections 103(1), 3(5) of the B.N.S., 2023 and Section 27 of the Arms Act.

As per F.I.R., on 12.08.2024 at 1.35 AM (Night), son of informant went outside for urinal, in the meantime, three miscreants boarded on one motorcycle and one miscreant on one motorcycle came and made three rounds of firing upon informant's son, due to which, informant's son got injured and fell down on ground and thereafter, all the miscreants fled away,
Patna High Court CR. MISC. No.12489 of 2025(3) dt.22-04-2025 2/3 out of whom, informant identified two miscreants namely Dipak Kumar and Sahil Kumar (petitioner). Informant took his son to hospital, where doctor declared him dead.
4. Learned counsel for the petitioner submits that petitioner has been falsely implicated in this case due to previous dispute. He further submits that during course of investigation, it transpired that there was love-affair of deceased with sister of co-accused Vikash Kumar and after the marriage of sister of Vikash Kumar, informant's son (deceased) always used to threaten him of making viral the messages and video of his sister and it was co-accused Naveen Kumar, who fired on the son of informant.

However, learned A.P.P. for the State vehemently opposes the prayer for anticipatory bail and submits that petitioner is named in the F.I.R. with specific accusation that he alongwith other co-accused persons killed the son of informant by fire-arm and thereafter, fled away from the place of occurrence. He further submits that co-accused Vikash Kumar confessed his guilt in his confessional statement and also disclosed the involvement of petitioner and others in the alleged crime. The deceased died due to haemorrhage and sock by firearm injuries.

6. Considering the aforesaid facts and circumstances, the prayer for anticipatory bail of petitioner is rejected. (Prabhat Kumar Singh, J) anay U T
