SINHA) 09-01-2015 Learned counsel for the appellant states that he may be permitted to withdraw this appeal with liberty to submit before the appropriate Sessions Court that the First Information Report and the charge-sheet concerning Motipur P.S. Case No. 40/14 are required to be placed before the Sessions Judge in the light of the direction of the Division Bench of this Court contained in Cr.W.J.C. No. 487 of 2014, disposed of under order No. 7 dated 04.08.2014. It is further submitted that once First Information Report and charge-sheet are placed before the competent Sessions Judge, the prayer made on behalf of the appellant including the prayer of bail in the present appeal be considered in accordance with law.
