JUSTICE HEMANT KUMAR SRIVASTAVA ORAL ORDER 07-01-2015 Heard learned counsel for the petitioner as well as learned Additional Public Prosecutor for the State. Petitioner is husband of the victim and is languishing in jail custody since 02.05.2014 in a case registered under section 498A/34 of the Dowry Prohibition Act. The contention on behalf of the petitioner is that petitioner was working at Gujrat and the victim was along with him but victim left Gujrat and came alone to her parental house and after that the informant lodged this case. It is contended by him that before learned court below victim flatly refused to lead her conjugal life with the petitioner.

Considering the aforesaid facts and circumstances as well as submissions of the parties, let the petitioner, above named, be released on bail on furnishing bail bonds of Rs. 10,000/- with

Patna High Court Cr.Misc. No.290 of 2015 (2) dt.07-01-2015 2/2 two sureties of the like amount each to the satisfaction of Chief Judicial Magistrate, Ara in connection with Sahar P.S.Case No. 113 of 2012.
