The petitioner apprehends his arrest in a case registered for the offence punishable under sections 147, 149, 341, 323, 504, 307 of the Indian penal Code.
It is alleged that the accused persons came to the door of the informant and assaulted him with khanti on his head. It is submitted by the learned counsel for the petitioner that specific allegation of assault is against co-accused Ramawadhesh Singh, Ramji Singh, Ashok Singh and Upendra Singh. The specific overt act has not been alleged against the petitioner. Petitioner is own brother of the informant aged about 70 years. The petitioner was not sent up for trial but the
Patna High Court Cr.Misc. No.53762 of 2015 (2) dt.26-11-2015 2/2 cognizance has been taken and the process has been issued against the petitioner also. .
Considering the aforesaid facts, let the above named petitioner be released on anticipatory bail in the event of his arrest or surrender before the learned Court below within a period of twelve weeks from today, on furnishing bail bonds of Rs. 10,000/- (Ten Thousand) with two securities of the like amount each to the satisfaction of C.J.M, Aurangabad in connection with Barun P.S. Case No. 124 of 2013, subject to the conditions laid down under section 438(2) of the Cr. P.C. (Dinesh Kumar Singh, J) M.Rahman/- U T
