JUSTICE DINESH KUMAR SINGH ORAL ORDER 20-01-2015 Petitioners are languishing in custody since 06.11.2014 in a case registered for the offences punishable under Sections 147, 148, 149, 307, 323, 326, 332, 333, 341, 353 of the I.P.C and Section 47(a) of the Excise Act. It is alleged that when seizure of illicit liquor was made from the shop of Kali Chaudhary then these petitioners and others protested and took away the seized liquor. They also threw hot oil on the police personnel as a result they received injuries.

It is submitted by learned counsel for the petitioners that accusation is not specific against the petitioners when a statement has been made in para 3 of the petition that petitioners have no criminal antecedent. Considering the aforesaid facts, let the

No.2284 of 2015 (2) dt.20-01-2015 2/2 petitioners, above named, be released on bail on furnishing bail bond of Rs. 10,000/-(ten thousand) each with two sureties of the like amount each to the satisfaction of learned Chief Judicial Magistrate, Saharsa in connection with Mahishi(Jalai) P.S. Case No. 97 of 2013.
