The petitioner has preferred this application for grant of regular bail in a case registered under section 392 of the Indian Penal Code.

As per the prosecution case, three accused persons on the point of pistol robbed the informant of his belongings. It is submitted by learned counsel for the petitioner that the F.I.R. was registered against unknown. The name of the petitioner transpired in course of investigation. From perusal of the order of the learned trial Court rejecting the application for bail of the petitioner, it would transpire that the material being used against the petitioner is his confessional statement and his antecedents. There is no material in the instant case to connect

Patna High Court CR. MISC. No.20543 of 2021(2) dt.21-09-2021 2/2 the petitioner with the alleged crime. The petitioner is in custody since more than 9 months. Charge sheet has been submitted without putting the petitioner on T.I. Parade. No incriminating article has been recovered from the petitioner's possession. Coaccused Arjun Kumar has been enlarged on bail vide order dated 29.7.2021 passed in Cr. Misc. no.218512 of 2021.

Heard learned A.P.P. for the State.

Having heard learned counsel for the parties and taking into consideration the facts of the case together with no incriminating article having been recovered from the petitioner's possession and chargesheeet having been submitted in the case without putting the petitioner on T.I. Parade, the Court directs the petitioner to be enlarged on bail in connection with Udwantnagar P.S. Case no. 25 of 2020 on furnishing bail bond of Rs.10,000/ (Rupees Ten Thousand) with two sureties of the like amount each to the satisfaction of the learned Bhojpur at Ara.
