2. The petitioner has prayed for bail in connection with Charpokhari P.S. Case No. 233 of 2025 registered for the offence punishable under Sections 126(2), 115, 76, 109, 303(2), 352 and 3(5) of B.N.S.
3. The case of the prosecution, in short, is that the petitioner who is father-in-law of the informant has attempted to outrage the modesty of the informant.
4. Learned counsel appearing on behalf of the petitioner has submitted that petitioner is innocent and has committed no offence. He has been falsely implicated in this case. It has further been submitted that prior to this case, informant has filed a case (Charpokhari P.S. Case No. 207 of
Patna High Court CR. MISC. No.10841 of 2026(4) dt.07-04-2026 2/2 2025) under Section 85 of B.N.S. and was living at her paternal house. On the date of the occurrence, she was not at her matrimonial house. It has further been submitted that it is just an off-set of that case to make the allegations serious. Petitioner is aged about 60 years and he is languishing in judicial custody since 20.10.2025
5. Learned APP appearing for the State has vehemently opposed the application for bail and has submitted that petitioner is having criminal antecedent of one case.
6. Having heard learned counsel for the parties and considering the facts and circumstances of the case, this Court is inclined to enlarge the petitioner on bail. The above named petitioner is directed to be enlarged on bail on furnishing bail bond of Rs. 10,000/- (Rs. ten thousand only) with two sureties of the like amount each to the satisfaction of the learned Judicial Magistrate 1st Class, Bhojpur at Ara in connection with Charpokhari P.S. Case No. 233 of 2025.
