Heard learned counsel for the petitioner and learned Additional Public Prosecutor for the State.

The petitioner is in custody since 22.07.2015 in connection with a case registered for the offences punishable under Sections 307/34 of the Indian Penal Code.

Learned counsel for the petitioner submits that though the petitioner is not named in the First Information Report subsequently, his name has surfaced. It is further submitted that allegation of firing is upon one Sanjay Paswan and not upon this petitioner. The said fact incorporated by Sanjay Paswan himself in the statement made in P.M.C.H., Patna.

Patna High Court Cr.Misc. No.3783 of 2016 (2) dt.10-02-2016 P2/2 Considering the nature of allegations and that the petitioner has been in custody since 22.07.2015, let the petitioner be released on bail on furnishing bail bonds of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of learned Chief Judicial Magistrate, Sitamarhi in connection with Persauni P.S. Case No. 56 of 2015.
