JUSTICE HEMANT KUMAR SRIVASTAVA ORAL ORDER 09-12-2015 Heard learned counsel for the petitioners as well as learned Additional Public Prosecutor for the State. Two rival groups were making firing against each others and in the meantime, police party reached there and caught the petitioners and also recovered some fire-arms. Police lodged two separate cases for making firing as well as recovery of firearms. Petitioners have already been granted privilege of bail in the case, which was lodged for recovery of fire-arms and so far as present case is concerned; the instant case has been lodged for making firing but admittedly, none has sustained any fire-arm injury.

Learned counsel, appearing for petitioners submits that

Patna High Court Cr.Misc. No.54498 of 2015 (2) dt.09-12-2015 2/2 the antecedent of petitioners has been disclosed at paragraph-3 of the petition. It is further contended by him that no doubt, petitioners have been made accused in several cases but as a matter of fact, whenever petitioners are caught in a particular case, police uses to lodge some other cases against petitioners for similar occurrence.

Taking note of the aforesaid submissions as well as this aspect of the matter that petitioners have already been granted privilege of bail for recovery of fire-arms, let the petitioners named above, be released on bail on furnishing bail bond of Rs. 10,000/- (ten thousand) each with two sureties of the like amount each in connection with Mokama P.S. Case No. 52 of 2015 corresponding to Sessions Trial No. 622 of 2015 to the satisfaction of learned Additional District & Sessions Judge-II, Barh. (Hemant Kumar Srivastava, J) A.K.V./- U T
