The petitioners apprehend their arrest in connection with Gardanibagh P.S. Case No. 335 of 2014 registered for offences punishable under Sections 406, 420, 467, 468, 471, 120B, 504,506/34 of the Indian Penal Code and 66 I.T. Act. It is contended on behalf of the petitioners that allegation of taking money for the purpose of managing employment is upon the son of the petitioner nos. 1 and 2 and the brother of the petitioner no.3, namely, co-accused Nityanand Kumar. Petitioners have been made accused only for the aforesaid reason without any specific allegation. In paragraph-15 of the case diary, it is merely stated against the petitioners that they were
Patna High Court Cr.Misc. No.16566 of 2016 (3) dt.24-05-2016 2/2 advertising in the entire area that his son Nityanand Kumar is managing employment for Chandan Kumar after taking Rs. 5 lacs. It is further contended that similar allegation has been made against the petitioners in another matter in which anticipatory bail has been granted by coordinate Bench of this Court.
Having regard to the facts and circumstances of the case, let the petitioners, namely, Ram Keshwar Kewat, Laksho Devi and Manish Kumar be released on bail in the event of arrest/surrender before the Court below within a period of six weeks from today in Gardanibagh P.S. Case No. 335 of 2014, on furnishing bail bond of Rs.10,000/- (Ten Thousand Rupees) each with two sureties of the like amount each to the satisfaction of Judicial Magistrate-Ist Class, Patna subject to the conditions as laid down under sub-section(2) of Section 438 of the Code of Criminal Procedure.
