JUSTICE HEMANT KUMAR SRIVASTAVA ORAL ORDER 01-12-2015 Heard learned counsel for the petitioner as well as learned Additional Public Prosecutor for the State. Petitioner is not named but in course of investigation, the spy of police and some witnesses disclosed the name of petitioner raising suspicion against him. One co-accused was arrested and made his confessional statement naming the petitioner. Subsequently, petitioner was also arrested and his confessional statement was recorded.

Nothing has been recovered from conscious possession of the petitioner and the looted mobile is said to have been recovered from possession of other co-accused. Petitioner has not been put on Test Identification Parade and is languishing

Patna High Court Cr.Misc. No.53977 of 2015 (2) dt.01-12-2015 2/2 in jail custody since 30.06.2015.

Considering the aforesaid facts and circumstances as well as submissions of the parties, let the petitioner be released on bail on furnishing bail bonds of Rs. 10,000/- (Ten Thousand) with two sureties of the like amount each to the satisfaction of Sri S.K. Srivastava, Judicial Magistrate, Raxaul at Motihari, East Champaran in connection with Chhauradano P.S. Case No. 23 of 2015.
