JUSTICE MOHIT KUMAR SHAH ORAL ORDER 07-09-2021 The instant petition has been taken up for consideration through the mode of Video Conferencing in view of the prevailing situation on account of COVID-19 Pandemic. Heard the learned Sr. counsel for the petitioner Mr. N. K. Agrawal, assisted by Ms. Preety Kunwar and the learned counsel appearing for the respondent- State Sri Upendra Pratap Singh AC to SC 4.

The present writ petition has been filed for directing

the District Magistrate-cum-Collector, Muzaffarpur to dispose of the pending Supply Appeal No. 45 of 2020-21, which has been preferred by the petitioner against the order dated 29.08.2020, passed by the S.D.O. East, Muzaffarpur, whereby and whereunder the P.D.S. licence of the petitioner bearing License no. 23/09/09/06/2019 has been cancelled. The learned counsel for the respondent- State Sri Upendra Pratap Singh (AC to SC 4) has got no objection, in case appropriate direction is issued for expeditious disposal of the aforesaid appeal.

Accordingly, the present writ petition stands disposed of with a direction to the learned District Magistrate, Muzaffarpur to dispose of the appeal in question, if not already disposed of, within a period of 08 weeks of receipt/ production of a copy of this order.
