JUSTICE DINESH KUMAR SINGH ORAL ORDER 07-12-2015 Heard learned counsels for the petitioner and the State. The petitioner is languishing in jail since 12.06.2015 in a case registered for the offences punishable under Sections 187, 20 and 22 of the NDPS Act.
The prosecution case is that the petitioner was carrying a bag on his back from which 3.40 Kgs of liquor opium were recovered.
It is submitted by learned counsel for the petitioner that quantity of contraband has not correctly been weighted. The petitioner is Army personnel. A statement has been made in para 3 of the petition that the petitioner has no criminal antecedent. Considering the commercial quantity of recovery, this Court is not inclined to grant bail to the petitioner. Accordingly, the prayer for regular bail of the
