The petitioner apprehends his arrest in a case registered for the offences punishable under Sections 307, 354B, 379 and other allied sections of the Indian Penal Code. As per the prosecution case, petitioner assaulted Sakila (informant) with Farsa on her head causing head injury. It is submitted that both parties are Gotia. As a matter of fact, on account of land dispute between the parties an altercation took place in which both sides sustained injuries. There is case and counter case. So far as allegation of theft and setting the house of informant on fire is against other co-accused persons. Petitioner claims clean antecedent. No.10413 of 2023(2) dt.15-05-2023 2/2 named, in the event of his arrest/surrender before the court below within a period of six weeks from the date of receipt/production of a copy of this order, is directed to be enlarged on bail on furnishing bail bond of Rs. 10,000/- (Ten thousand) with two sureties of the like amount each to the satisfaction of the learned Chief Judicial Magistrate, Araria in connection with Narpatganj P.S. Case No. 115 of 2017, subject to the conditions as laid down under Section 438(2) of the Code of Criminal Procedure.
