No doubt, petitioner was caught on the spot but according to prosecution case itself, the raid was conducted in the house of co-accused, Ram Kripal Sahani and incriminating articles including fire-arms, were recovered from possession of other coaccused. It appears from perusal of paragraph-3 of the petition that prior to institution of present case, only one case and, that too, for the offence punishable under Sections-341 and 379 of the Indian Penal Code, had been lodged against the petitioner.
