JUSTICE DINESH KUMAR SINGH ORAL ORDER 25-09-2018 Heard Mr. Shambhu Sharan Singh, learned counsel for the petitioner and Mr. Gyan Shankar, learned AC to GP-2 for the respondent-State.

Though the present writ application has been filed with a prayer for calling for the records of Matrimonial (Divorce) Case No. 332 of 2012 filed under Section 13 (B) of Hindu Marriage Act, and to decide the same before this Court, but at present, learned counsel for the petitioner confines his prayer only to the extent for a direction to the Principal Judge, Family Court, Bhagalpur, to dispose of the Matrimonial (Divorce) Case No. 332 of 2012.

Though the first part of the prayer appears to be misconceived but in view of the confined prayer of the learned

Patna High Court CWJC No.6682 of 2017(2) dt.25-09-2018 2/2 counsel for the petitioner, this Court is not inclined to issue notice to private Respondent No.2.

However, it is expected from the Principal Judge, Family Court, Bhagalpur, to conclude the proceeding of the Matrimonial (Divorce) Case No. 332 of 2012, expeditiously in accordance with law.

Accordingly, the present writ application is disposed of.
