The petitioner, Guddu Miya, seeks regular bail in Ara Nagar P.S. Case No.189 of 2014, registered under Section 399 and other sections of the Indian Penal Code and other sections of the Arms Act.

On confidential information, the police raided a lonely place, Kabristan. From there, three persons Md. Mallu @ Muzhar @ Mumtaz, Ajay Sao @ Uma Sao and Md. Akbar were apprehended. From the possession of Md. Mallu @ Muzhar @ Mumtaz country made pistol and one live cartridge and one live cartridge was recovered from Md. Akbar. The apprehended accused disclosed the name of the petitioner Guddu Miya. The petitioner was not apprehended on the spot and nothing was recovered from the possession of the petitioner. Patna High Court Cr.Misc. No.386 of 2015 (2) dt.08-01-2015 2/2 jail since 26.08.2014.

Considering the facts and circumstances of the case, the prayer for bail is allowed.

The petitioner, above named, is directed to be released on bail on furnishing bail bond of Rs.10,000/- (Ten Thousand) with two sureties of the like amount each to the satisfaction of Chief Judicial Magistrate, Bhojpur at Ara in connection with Ara Nagar P.S.
