Petitioner apprehends his arrest in a case filed under Sections 363, 366A/34 of the Indian Penal Code. It is submitted on behalf of the petitioner that the main accused Pankaj Sharma has already been enlarged on bail and after that case, another case, i.e, Parbatta P.S. Case No.95/2014 was lodged by the uncle of the girl in which the girl's statement was again recorded under Section 164 of the Cr.P.C. which has been appended as Annexure 6 in which she has stated that her parents had thrown her out of the house and, thereafter, she had gone with her husband Pankaj Sharma and were living

Patna High Court Cr.Misc. No.1170 of 2016 (2) dt.15-01-2016 2 / 2 together in Delhi. She has stated that she has a one and half year old daughter also out of the wedlock.

Having regards to the facts and circumstances, in the event of arrest/surrender within a period of six weeks from today in Parbatta P.S. Case No.276/2013, the above named petitioner, Sumit Ray shall be released on bail on furnishing bail bond of Rs.10,000( Ten Thousand Rupees) with two sureties of the like amount each to the satisfaction of Chief Judicial Magistrate, Khagaria subject to the conditions as laid down under sub-section(2) of Section 438 of the Code of Criminal Procedure.
