JUSTICE MOHIT KUMAR SHAH ORAL ORDER 29-02-2020 This is an application for grant of anticipatory bail in connection with Excise case no. 448 of 2019 registered for the offences punishable under Section 30(a) of Bihar Prohibition and Excise Act, 2016.

After some arguments, the learned counsel for the petitioner seeks to withdraw the present petition with liberty to surrender before the learned court below and seek regular bail. Accordingly, the present petition stands disposed off as not pressed, however with liberty to the petitioner to approach the learned court below by surrendering within a period of four weeks from today and seek regular bail. It is needless to state that in case, the petitioner surrenders before the learned court below within a period of four weeks from today and prays

Patna High Court CR. MISC. No.8830 of 2020(2) dt.29-02-2020 2/2 for regular bail, his prayer for regular bail shall be considered and disposed off on the very same day, considering the fact that a trivial quantity of illicit liquor has been recovered and moreover, the petitioner was not present at the place, from where the illicit liquor has been recovered.

The present writ petition stands disposed off on the aforesaid terms.
