The petitioner is languishing in custody since 18.07.2014 in a case registered for the offences punishable under Sections 341, 323 and 376 of the Indian Penal Code. The accusation against the petitioner is of establishing forceful physical relationship with the minor daughter of the informant.

It is submitted by learned senior counsel for the petitioner that the occurrence is of 12.07.2014 at 4.00 P.M. whereas the FIR was registered on 13.07.2014 at 1.05 P.M. when the police station was only 1 1⁄2 km away from the place of occurrence. The victim was examined by a medical board of five

Patna High Court Cr.Misc. No.510 of 2015 (02) dt.09-01-2015 2/2 doctors on 14.07.2014 but they did not find any trace of sexual assault. The age of the victim was assessed between 14 to 16 years. It is further submitted that in the background of tenancy dispute from before the accusation has been levelled. Considering the aforesaid facts, let the above named petitioner, be released on bail on furnishing bail bonds of Rs.10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of learned Chief Judicial Magistrate, Araria in connection with Jogbani P.S. Case No. 77 of 2014.
