This application for grant of anticipatory bail arises out of Goraul P.S. Case No. 362 of 2020 registered for the offence under Section 30(a) of the Bihar Prohibition & Excise Act. This is the second anticipatory bail application on behalf of the petitioner. Earlier, the petitioner has moved before this Court for anticipatory bail in Criminal Miscellaneous No.15481 of 2021, which was rejected vide order dated 03.12.2021.

In view of the recent decision of the Apex Court in the case of G.R. Ananda Babu vs. State of Tamil Nadu & Anr. reported in 2021 SCC OnLine SC 176, second anticipatory bail is not maintainable. Hence, this bail application is dismissed. (Sandeep Kumar, J) pawan/- U T
