2. The petitioner seeks bail in a case registered for the offence punishable under Sections 127(1), 115(2), 109, 303(2), 117(2), 76, 352, 351(2), 3(5) of the B.N.S..
3. As per the prosecution case, the petitioner along with other co-accused have assaulted the father of the informant by various means. It is also alleged that mother of the informant was also assaulted in an attempt to save her husband.
4. Learned counsel for the petitioner submits that no such occurrence as alleged ever took place. He is quite innocent and has been falsely implicated in this case. The allegation levelled against the petitioner is not specific rather
Patna High Court CR. MISC. No.9411 of 2025(2) dt.28-02-2025 2/2 general and omnibus in nature. He submits that the informant is not eye-witness to this occurrence. Similary situated coaccused has been enlarged on bail by a co-ordinate bench of this court vide order dated 28.01.2025 passed in Cr. Misc. No. 78761 of 2024. The petitioner has three criminal antecedents and has been languishing in custody since 14.11.2024.
5. Learned APP for the State opposed the bail petition.
6. Considering the facts aforesaid, the above named petitioner is directed to be enlarged on bail, after framing of charge, on furnishing bail bond of Rs. 25,000/- (Rupees Twenty Five Thousand) with two sureties of the like amount each to the satisfaction of the learned Court below where the case is pending/successor Court in connection with Rupau P.S. Case No.49 of 2024.
