JUSTICE HEMANT KUMAR SRIVASTAVA ORAL ORDER 04-01-2016 Heard learned counsel for the petitioner as well as learned Additional Public Prosecutor for the State. Petitioner was neither caught on the spot nor anything was recovered from his conscious possession. The alleged recovery was made from joint house of petitioner and his father, namely, Jagdish Singh. Co-accused, Jagdish Singh has already been granted privilege of bail by a coordinate bench of this court. The petitioner does not have any criminal antecedent and is languishing in jail custody since 12-08-2015. So far as recovery of rifle is concerned; the same appears to be licensee one.

Considering the above-said facts and circumstances of the case as well as submission of the parties, let the petitioner

Patna High Court Cr.Misc. No.57946 of 2015 (2) dt.04-01-2016 2/2 named above, be released on bail on furnishing bail bond of Rs. 10,000/- (ten thousand) with two sureties of the like amount each in connection with Udwant Nagar P.S. Case No. 257 of 2014 to the satisfaction of learned Chief Judicial Magistrate, Bhojpur at Ara.
