At the very outset, the learned counsel for the petitioners has submitted that during the pendency of this anticipatory bail petition, petitioner no. 1, namely, Laloo Chaupal @ Lalo Chaupal has been arrested and, as such, it has become infructuous with respect to him. He, therefore, seeks permission to withdraw this petition with respect to petitioner no. 1.

3. In view of the aforesaid submission, this petition is dismissed as withdrawn with respect to petitioner no. 1.

4. The petitioner nos. 2 to 5 apprehend their arrest in connection with Gaighat P.S. Case No. 220 of 2024 registered for the offences punishable under Sections 80, 3(5) of the BNS.

5. As per the prosecution case, marriage of daughter of the informant was solemnized with co-accused Subodh Chaupal in the year 2021 according to Hindu customs. The accused persons tortured her for non-fulfillment of demand of Rs. 1 lakh as dowry. On 01.09.2024, the accused persons strangulated her to death.

6. Learned counsel for the petitioners has submitted that the petitioners are innocent and have falsely been implicated in this case. He has further submitted that the petitioners are in-laws of the deceased having no concern with the day-to-day affairs of the couple. As a matter of fact, the deceased committed suicide and the postmortem report shows that except abrasion mark on the neck, there is no mark of violence on her body. It has further been submitted that the informant filed an affidavit stating therein that the mental state of her daughter (the deceased) was not good and her behavior was not natural. The matrimonial inmates kept her daughter with dignity and honour.

7. The petitioners are in-laws of the deceased and the informant herself has filed an affidavit accepting innocence of the

Considering the above-mentioned facts and circumstances, let the petitioner nos. 2, 3, 4 and 5, in the event of their arrest or surrender within four weeks before the learned court below, be released on bail on furnishing bail bond of Rs. 10,000/- (Ten Thousand) each with two sureties of the like amount each to the satisfaction of learned J.M.F.C. (East), Court No. 2, Muzzaffarpur in connection with Gaighat P.S. Case No. 220 of 2024, subject to the conditions as laid down under Section 438(2) Cr.P.C./ 482(2) of the BNSS, 2023.
