JUSTICE MOHIT KUMAR SHAH ORAL ORDER 26-11-2018 After some arguments, the learned Senior Counsel for the petitioner seeks liberty to file objection under Section 9 of the Bihar & Orissa Public Demand Recovery Act, 1914 and till the passing of the final order, the petitioner seeks a direction upon the Certificate Officer not to take any coercive steps. In view of the limited prayer made by the learned Senior counsel for the petitioner, the present writ petition is disposed of with liberty to the petitioner to file objection under Section 9 of the Bihar & Orissa Public Demand Recovery Act, 1914 within a period of four weeks from today and in case such an objection is filed, the Certificate Officer, Munger shall be obliged to pass reasoned order on merits, after hearing the petitioner herein.

Patna High Court CWJC No.11133 of 2017(2) dt.26-11-2018 2/2 Till the final disposal of the certificate proceedings, no coercive steps shall be taken against the petitioner in connection with Certificate Case No. 02 of 2017-18 . It is needless to state that in case no objection is filed within a period of four weeks from today, the Certificate Officer shall proceed ex parte.
