This is an application for grant of anticipatory bail in connection with Naubatpur PS case no. 662 of 2019 registered for the offences punishable under Sections 386, 387, 120(B) of Indian Penal Code and 25(1-B)a, 26 of Arms Act.

The case of the prosecution in brief is that the informant got a secret information that a boy is collecting extortion money from the shopkeepers of Naubatpur Bazar, whereafter the police party had raided at the market place and arrested the said boy who disclosed his name as Pintu Kumar and upon interrogation, he is stated to have disclosed that he used to work for Kishanji @ Boss as also disclosed the name of the other accomplices including the petitioner herein.

No.8898 of 2020(3) dt.25-06-2020 2/3 The learned counsel for the petitioner has submitted that the petitioner has been falsely implicated in the present case, is innocent and has got no complicity in the alleged offence. It is further submitted that the name of the petitioner has transpired upon the confessional statement being made by the co-accused person namely Pintu Kumar who was arrested by the police and except the said confessional statement, there is no material on record to connect the petitioner with the alleged crime. It is further submitted that the similarly situated co-accused persons have already been granted bail by co-ordinate Benches of this Court vide order dated 24.02.2020 passed in Cr. Misc. no. 1263 of 2020, order dated 03.03.2020 passed in Cr. Misc. no. 5128 of 2020 and order dated 02.03.

Patna High Court CR. MISC. No.8898 of 2020(3) dt.25-06-2020 3/3 crime, I deem it fit and appropriate to admit the petitioner to the privilege of anticipatory bail. Accordingly, the abovenamed petitioner, in the event of his arrest or surrender before the learned court below within a period of six weeks from the date of receipt/ production of a copy of this order, is directed to be released on anticipatory bail on furnishing bail bond of Rs. 10,000/-(Rs. Ten thousand) with two sureties of the like amount each to the satisfaction of learned A.C.J.M.-II, Danapur, Patna in connection with Naubatpur PS case no. 662 of 2019 subject to the conditions as laid down under Section 438(2) of Code of Criminal Procedure.
