Petitioner seeks bail in a case registered for the offences punishable under Sections 147, 148, 149, 341, 323, 448, 337, 342, 307, 504 of the Indian Penal Code and Section 27 of the Arms Act.

For land dispute, the firing resorted by this petitioner caused injury on the leg of Vidyawati Kumari. Petitioner is in custody since 23.01.2018.

Submission of learned counsel for the informant is that the petitioner has got two identical criminal antecedents. Charges have been framed recently on 25.04.2019 by the learned Trial Judge.

Further submission is that the prayer is pre-matured for the reason that while refusing prayer for bail on 12.04.2018

Patna High Court CR. MISC. No.9985 of 2019(4) dt.02-05-2019 2/2 vide order at Annexure 1, a Bench of this Court had observed that petitioner may renew his prayer for bail after nine months of the framing of charges, if the trial does not conclude in the meantime.

Considering the period already undergone by the petitioner and undertaking of the petitioner that he shall fully co-operate with the trial, let the petitioner, above named, be released on bail on furnishing bail bond of Rs.20,000/- (Rupees Twenty Thousand) with two sureties of the like amount each to the satisfaction of learned Court below where the case is pending in connection with Ghosi Police Station Case No. 107 of 2017, with the following conditions:

(a) Both the bailors shall be the resident of territorial jurisdiction of the learned court-below having immovable property.

(b) The petitioner shall fully cooperate with the investigation/trial of the case, failing which the court below shall be at liberty to cancel the bail bond of the petitioner. (Birendra Kumar, J) Rajan/- U T
