In the present case, the petitioner is seeking bail in Deoriya P.S. Case No. 173 of 2019 registered for the offence punishable under Sections 25 (1-B)a, 26 and 35 of the Arms Act.
Allegation against the petitioner is that a country made pistol with cartridge has been recovered from his possession, however, it is urged that the petitioner is in judicial custody since 03.12.2019.
Considering the facts and circumstances of the case, the petitioner, above-named, is directed to be released on bail on furnishing bail bond of Rs.10,000/-(Rupees Ten Thousand) with two sureties of the like amount each to the satisfaction of
Patna High Court CR. MISC. No.8215 of 2020(4) dt.30-06-2020 2/2 Judicial Magistrate-1st Class, Muzaffarpur in connection with Deoriya P.S. Case No. 173 of 2019 with a further condition that if the petitioner, after his release in this case, is again found involved in similar nature of cases then the concerned court would be at liberty to take steps for cancellation of his bail bonds. Further condition is that whenever the police will call the petitioner for the purposes of investigation and interrogation, he will remain present for the investigation. In the event of being absent on two consecutive dates without reasonable explanation, the present order will be treated to have been cancelled. (Shivaji Pandey, J) V.K.Pandey/- U T
