The petitioner has preferred this application for grant of regular bail in a case registered under sections 353, 355 and 34 of the Indian Penal Code.

As per the prosecution case, the son of the informant was forcefully taken away by Anwar Diwan to Tamil Nadu for child labour.

It is submitted by learned counsel for the petitioner that the petitioner is not named in the FIR. He was falsely implicated in the case. Even from the contents of the statement of the victim under section 164 Cr.P.C. the main allegation of kidnapping is against one Ibrahim Mian who has been enlarged

Patna High Court CR. MISC. No.20600 of 2021(3) dt.22-10-2021 2/2 on bail vide order dated 29.4.2019 passed in Cr. Misc. No. 17097 of 2019. The petitioner is in custody since 5.10.2020 and has no criminal antecedent. Chargesheet has been submitted in the case.

Having heard learned counsel for the parties and taking into consideration the facts and circumstances of the case together with the petitioner having remained in custody for over 1 year and grant of bail to co-accused Ibrahim Mian, the petitioner is directed to be enlarged on bail in connection with Harsidhi P.S. Case no. 40 of 2018 on furnishing bail bond of Rs. 10,000/- (Rupees Ten Thousand) with two sureties of the like amount each to the satisfaction of the learned Chief Judicial Magistrate, East Champaran.
