This application for anticipatory bail arises out of Ramnagar P.S. Case No. 249 of 2018, disclosing the offence under Section 7 of the Essential Commodities Act. It is evident from the FIR that a private person had seized three bags of rice containing 50 kg each and informed the informant i.e. the Assistant District Supply Officer, West Champaran in this regard. It is alleged in the FIR that these petitioners accepted that they had purchased the rice from a PDS dealer. Evidently, they are said to have given in writing their statements to the informant in this regard. The PDS dealer is said to have been released on regular bail by the court below.
Patna High Court Cr.Misc. No.10469 of 2019(2) dt.22-02-2019 2/2 Considering the above submission, this application is allowed. Let the petitioners, above named, in the event of their arrest/surrender within six weeks from today in the court below, be released on bail on furnishing bail bonds of Rs.10,000/- (ten thousand) each, with two sureties of the like amount each, to the satisfaction of the learned Addl. Sessions Judge 1st-cumSpecial Judge, West Champaran in Ramngagar P.S. Case No. 249 of 2018, subject to the condition as laid down under Section 438 (2) of the Code of Criminal Procedure.
This is subject to the condition that the petitioners shall present themselves before the Police/Court, as the case may be, as and when required, and in the event of failure on their part to appear before the court on two consecutive occasions, their bail bonds shall be liable to be cancelled.
