JUSTICE VINOD KUMAR SINHA ORAL ORDER 20-02-2020 Petitioner seeks regular bail in connection with Danapur P.S. Case No. 347 of 2019, G.R. No. 1567 of 2019 registered for the offence punishable under Section 379 of the Indian Penal Code.

Petitioner was not named in the FIR, his name was transpired on the confession. Allegation against him of thefting of motor vehicle and he is an accused of four others similar type of cases.

Submission of learned counsel for the petitioner is that except confession there is nothing against him. He is in custody since 22.07.2019. Charge-sheet has already been submitted, there is no chance of tempering with the evidence and the other accused persons have already been granted bail by the learned co-ordinate Bench of this Court vide order dated 05.02.2020 passed in Cr. Misc. No. 8188 of 2020.

Having heard both sides, in view of the facts and circumstances, as stated above, let the petitioner above named, be released on bail on furnishing bail bond of Rs.25,000/- (Rupees Twenty Five Thousand) with two sureties of the like amount to the satisfaction of learned A.C.J.M.-I, Danapur in connection with Danapur P.S. Case No. 347 of 2019, G.R. No. 1567 of 2019, subject to the condition that one of the bailors of the petitioner shall be a local person having sufficient immovable property within the jurisdiction of the court concerned with condition that after release, he has to appear before the police of his local area for a period of six months or till the conclusion of the trial, whichever is earlier, so that the police may watch his conduct, otherwise his bail bond shall be cancelled.
