The petitioners, who are the Teacher and Secretary of the Primary School, Mureth Hindi, seek bail in anticipation of their arrest in connection with Arer P. S. Case No. 91 of 2016 dated 15.10.2016 instituted for the offences under Sections 406, 409, 420 and 34 of the Indian Penal Code. From the perusal of the F.I.R., it appears that money which was withdrawn by the Incharge Headmaster of the School for the purposes of construction of a building could not be completed. Hence, the subject F.I.R. has been lodged. However, during the course of investigation, the Incharge Headmaster, namely, Avinash Kumar, gave an undertaking that

Patna High Court Cr.Misc. No.10508 of 2019(2) dt.22-02-2019 2/2 he shall get the work concluded shortly. The construction work is being carried out.

It has further been submitted that during the course of investigation / supervision, the name of the petitioners also transpired.

Regard being had to the fact that the Incharge Headmaster has been granted anticipatory bail and the construction work in the school is being carried out, the petitioners, above-named, are directed to be released on bail, in the event of their arrest or surrender before the court below within a period of four weeks from the date of receipt / production of a copy of this order, on their furnishing bail bonds in the sum of Rs. 10,000 /- (Ten Thousand) each with two sureties of the like amount each to the satisfaction of the learned Judicial Magistrate, 1st Class, Benipatti, District - Madhubani in connection with Arer P. S. Case No. 91 of 2016, subject to the conditions as laid down under Section 438 (2) Cr.P.C.
