JUSTICE DINESH KUMAR SINGH ORAL ORDER 15-01-2015 Petitioner is languishing in custody since 29.09.2013 in a case registered for the offences punishable under Sections 279, 337, 338, 304(A) of the I.P.C. The petitioner was the informant of the case, where it was alleged that on 14.04.2013 the petitioner was going to attend the marriage ceremony with Malik Yanatullah and they met with an accident when Malik Yanatullah died on the spot and petitioner received injuries. Subsequently during investigation it transpired that the brother-in-law of the victim Bajmuzma, in conspiracy with this petitioner killed the victim due to the property dispute. The petitioner also admitted this fact that Bajmuzma and others killed the victim in his 161 and 164 Cr.P.C statements.

Considering the fact that the evidence collected during investigation suggests that petitioner conspired

Accordingly the application is dismissed in connection with Jhanjharpur(Araria Sangram) P.S. Case No. 39 of 2013, pending in the Court of learned Additional Chief Judicial Magistrate, Jhanjharpur.

Let the trial be expedited.
