The petitioner is languishing in jail since 29.09.2015 in a case registered for the offences punishable under Sections 20, 22 and 23 of the NDPS Act.
From the house of Md. Munna @ Rummi, 30.07 gm of smack and 182 gm of ganaja were recovered. The petitioner was found present in the house of co-accused Md. Munna @ Rummi along with others.
It is submitted by learned counsel for the petitioner that admittedly the recovery is made from the house of the co-accused Md. Munna. A statement has been made in para 3 of the petition that the petitioner has no criminal antecedent. Considering the fact that no recovery was made from the petitioner, let the above named

No.54563 of 2015 (2) dt.07-12-2015 2/2 petitioner be released on bail, on furnishing bail bond of `10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of learned Sessions Judge-cum-Special Judge, Muzaffarpur in connection with Ahiyapur P.S. Case No. 917 of 2015.
