JUSTICE DINESH KUMAR SINGH ORAL ORDER 07-12-2015 Heard learned counsels for the petitioner and the State. The petitioner is languishing in jail since 29.09.2015 in a case registered for the offences punishable under Sections 20, 22 and 23 of the NDPS Act.

From the house of Md. Munna @ Rummi, 30.07 gm of smack and 182 gm of ganaja were recovered. The petitioner was found present in the house of co-accused Md. Munna @ Rummi along with others.

It is submitted by learned counsel for the petitioner that admittedly the recovery is made from the house of the co-accused Md. Munna. A statement has been made in para 3 of the petition that the petitioner has no criminal antecedent. Considering the fact that no recovery was made from the petitioner, let the above named
