JUSTICE HEMANT KUMAR SRIVASTAVA ORAL ORDER 09-12-2015 Heard learned counsel for the petitioner as well as learned Additional Public Prosecutor for the State. Taking into consideration the nature of allegation as well as facts and circumstances of the case, I am not inclined to release the petitioner on bail and accordingly, his prayer for bail in connection with Kharagpur (Gangata O.P.) P.S. Case No. 131 of 2013 corresponding to Sessions Trial No. 669 of 2013 stands rejected.

However, it appears from perusal of the impugned order that except the I.O. and the doctor, almost all the prosecution witnesses have already been examined and the trial court has already issued bailable warrant to procure the attendance of the investigating officer and the doctor.

Patna High Court Cr.Misc. No.54652 of 2015 (2) dt.09-12-2015 2/2 Learned trial court must expedite the trial of the petitioner and conclude the same as early as possible. Copy of the order be sent to the Superintendent of Police, Munger with direction to him to ensure the presence of the investigating officer and the doctor of Kharagpur (Gangata O.P.) P.S. Case No. 131 of 2013 corresponding to Sessions Trial No. 669 of 2013 before the court of learned Additional District & Sessions Judge-V, Munger within a month from the date of receipt/production of copy of this order.
