The petitioner seeks bail in Kharik P.S. Case No. 146 of 2014, registered for the offences punishable under Section 366A and other Sections of the Indian Penal Code. The mother of the victim made allegation that the petitioner and others kidnapped his daughter on 17.03.2014. Submission is that the occurrence took place on 17.03.2014, but the FIR was lodged on 08.09.2014 i.e. after six months of the occurrence. The victim made her statement under Section 164 of the Cr.P.C. and she disclosed that she voluntarily went along with the petitioner and solemnized marriage. She disclosed her age to be 19 years. The victim did not support the factum of her kidnapping.

Patna High Court Cr.Misc. No.2454 of 2015 (2) dt.20-01-2015 Considering the facts aforesaid and the fact that after six months of the occurrence the informant filed the case of kidnapping of her daughter but the victim denied the factum of her kidnapping, the petitioner is directed to be enlarged on bail on furnishing bail bond of Rs. 10,000/- (Ten Thousand) with two sureties of the like amount each to the satisfaction of the learned Ist Additional District & Sessions Judge, Bhagalpur in connection with Kharik P.S. Case No. 146 of 2014.
